By accessing or using our platform, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with any part of these Terms, you must not use our services. These Terms constitute a legally binding agreement between you and novashard.

novashard provides an online platform that facilitates:

• Customer support and account services

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.

5. Application Process

When you submit a loan application through our platform:

• All information provided must be accurate and complete
• We may verify information through third-party sources
• Applications are subject to credit assessment and approval
• We reserve the right to decline applications at our discretion
• Approved applications will result in separate loan agreements

6. Intellectual Property

The novashard platform, including all content, features, and functionality, is owned by novashard SARL and is protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute our platform content
• Use our trademarks or branding without permission
• Reverse engineer or attempt to extract source code
• Create derivative works based on our platform

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of personal data is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to the processing of your personal data as described in our Privacy Policy.

8. Prohibited Uses

You may not use our platform for:

• Any unlawful purpose or activity
• Fraudulent or deceptive practices
• Money laundering or terrorist financing
• Violating any applicable laws or regulations
• Interfering with platform security or functionality
• Attempting to gain unauthorised access to our systems

9. Fees and Charges

Fees and charges for our lending services are detailed in individual loan agreements and related documentation. We reserve the right to modify our fee structure with appropriate notice to existing customers.

10. Limitation of Liability

To the maximum extent permitted by law, novashard shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services.

Our total liability to you for any claims arising from these Terms or your use of our services shall not exceed the amount of fees paid by you to novashard in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless novashard, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Luxembourg. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the Luxembourg courts.

For customers in other EU member states, you may also have the right to bring proceedings in the courts of your country of residence.

13. Termination

We may terminate or suspend your access to our platform immediately, without prior notice, if you breach these Terms or engage in any conduct that we determine to be harmful to our business or other users.

You may terminate your account at any time by contacting our customer support team. Termination does not affect any outstanding obligations under existing loan agreements.

Upon termination:

• Your right to use our platform ceases immediately
• We may delete your account and data
• Existing loan obligations remain in effect
• Provisions that should survive termination will continue to apply

14. Force Majeure

novashard shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, or government actions.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any applicable loan agreements, constitute the entire agreement between you and novashard regarding your use of our services.

17. Amendments

We may modify these Terms at any time by posting the revised Terms on our platform. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.
